In this Privacy Policy (“Policy”), we describe how Oxazon, LLC (“Backstory”) collects, uses, and discloses information that we obtain about visitors to our website, https://backstory.app (the “Site”), users of our mobile application (the “App”) and the services available through our Site and App (collectively, the “Services”).
By visiting the Site, using or downloading the App, or using any of our Services, you agree that your personal information will be handled as described in this Policy. Your use of our Site, App or Services, and any dispute over privacy, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. The Backstory Terms of Service are incorporated by reference into this Policy.

The Information We Collect About You
We collect information about you directly from you and from third parties, and automatically through your use of our Site or Services.
Information We Collect Directly From You. The information we collect from you depends on how you use our Services.

Account Creation. The features that you may use on our Site and App will depend on whether you have created an account with us and what type of account you create.

Creators. To register for an account as a creator (“Creator”), you will need to download our App and provide information, such as your name, email address, password, and mobile telephone number. Optionally, you may provide your birthday (month and day). If you register as a Creator you will have the ability on our App to organize and share your photographs and videos (your "Images"), view, comment on, and thank another Creator for images they share with you, and share groups, tags and face tags with Joint Account Users (as defined below). [Creators can also view and comment on shared images and thank another Creator for sharing images on our Site.] If you share images through the App, we automatically create a profile for you that includes your first name, last name, email and profile picture. We will share that profile with users with whom you share your images. If you share images through the App using a shared group, we will share the images, image locations, image dates, image captions, image tag(s), image face tag(s), and the group name with users with whom you share the group. If you share images through the App using a shared face tag, we will share the images, image locations, image dates, image captions, image tag(s), image face tag(s), and first and last name of the face with users with whom you share the face tag.

Joint Account Users. A Creator may provide the [name and] mobile telephone number of an individual, such as a partner or other family member, whom the Creator would like to invite to be a joint user on the Creator’s account (a “Joint Account User”). If you are a Joint Account User who has accepted a Creator’s invitation, you may register for an account by downloading our App and providing your name, email address, password, and mobile telephone number. Optionally, you may provide your birthday (month and day). If you register as a Joint Account User you will have the ability on our App to organize and share your images, view, comment on, and thank another Creator for images they share with you, and share groups and face tags with the Creator who invited you to participate in our Services. [Join Account Users can also view and comment on shared images and thank another Creator for sharing images on our Site.] If you share images through the App, we automatically create a profile for you that includes your first name, last name, email and profile picture. We will share that profile with users with whom you share your images. If you share images through the App using a shared group, we will share the images, image locations, image dates, image captions, image tag(s), image face tag(s), and the group name with users with whom you share the group. If you share images through the App using a shared face tag, we will share the images, image locations, image dates, image captions, image tag(s), image face tag(s), and first and last name of the face with users with whom you share the face tag.

Viewers. A Creator may provide the name, email and mobile telephone of an individual with whom the Creator would like to share images (a “Viewer”). To register for an account as a Viewer, you must provide information, such as your name, email address and password through our Site. Optionally, you can provide your mobile telephone number. Viewers may view shared images, comment on shared images, and thank a Creator for sharing images on our Site, but not on our App.

Creators, Joint Account Users and Viewers are collectively referred to in this Policy as “users”.

Content Recognition. We use image recognition technology provided by our service providers to recognize when Creators or Joint Account Users upload different images of the same person. We use this technology to provide our Services and to enhance the Services that we provide (for example, to make it easier to tag individuals' faces whose images you have already uploaded, or to create slideshows or montages that include images of the same person). We do not share the image recognition data with other users other than a Creator’s Joint Account User for the benefit of that Joint Account User’s account.

Payments Processing. If you purchase a subscription to our services where payment is required, or purchase other goods or services from us, our service providers will collect your payment information, such as your credit or debit card information and your billing address, and will use that information to process your payments. They may provide some information about your transaction, such as the last four digits of your credit card number or confirmation that your payment has processed, back to us.

Managing your Images in the App. If you are a Creator or a Joint Account User, when you sign in to the App for the first time, we will ask for permission to access your photo libraries so that you can use our technology to review your images, help you organize them (e.g., by creating tags that can be used to categorize your images), help you share them, and choose which images to upload to your account. In addition, we will ask for access to your contacts in your phone, to allow you to more easily choose individuals with whom you would like to share images. Note that if you do not give us access to your contacts, you will still be able to manually input contacts into the App. We will collect other content that you choose to add, such as the names of groups and face tags that you create for your images, captions for your images, and the locations and timestamps of your images. While you are organizing your images, we will collect Apple’s or Android’s unique identifier for the image and your device, your phone model and name, the file size and content type, the original file name, location data, timestamps related to the image, and image dimensions and orientation.

Contacting Us. If you use a chat feature that we make available on the Site, we will collect the information that you submit to the chat feature and will use it to respond to your requests and collect information about the performance of the Site and App. We will store information that we collect from the chat feature in order to provide better customer service to you in the future, for other quality and training purposes, and to perform analytics on the performance of our Site and App. If you submit an inquiry through our Site, we will collect your email address and the content of your request, as well as other information that you have the option to provide, such as your name, whether you have an account with us and any screenshots you choose to provide. You may also provide your email address to receive news and other updates from us or submit other requests on the Site and through the App.

Surveys and Questionnaires. We may send you surveys or questionnaires and use your responses to better tailor our Services.

Customer Service. If you report a bug on our Site or App, so that we can troubleshoot the bug, our service provider will collect information related to your request, such as your email address, your activities preceding the bug, your App version, operating system, location, locale, device brand and model, current view when reporting the bug, duration of your session, screen size, bundle id, and other information you choose to provide, including comments, screenshots and other recorded images of your screen. Our service provider will provide that information to us.

Careers. If you would like to apply for one of the positions listed on our Site, you must provide your name, email address, and telephone number. You will also have the option to provide other information such as the department you are interested in, the data you are available, a copy of your resume, and other information about why you are interested in working with us.
Information We Collect Automatically. We automatically collect information about your use of our Site and App through cookies, web beacons, and other technologies, including geolocation technology and technologies designed for mobile apps. To the extent permitted by applicable law, we combine this information with other information we collect about you, including your personal information.
When you visit the Site, we automatically collect the following information:

While you are organizing your images, we will collect the number of images on your device, Apple’s or Android’s unique identifier for each image, your device model and name, the file size and content type, the original file name, location data (either from Apple or based on the picture’s metadata), timestamps related to the Image, and Image dimensions and orientation.

How We Use Your Information
We use your information, including your personal information, for the following purposes:

Providing Our Services. To provide our Services to you; to fulfill your orders; to communicate with you about your use of our Services; to respond to your inquiries, and for other customer service purposes, such as troubleshooting issues. To send you informational text messages about our services, including to confirm your subscription or enroll you in multi-factor authentication. To create montages and other compilations and content that may interest you and to give you the option to cast that content through other media channels.

Customizing Your Experience. To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Services.

Marketing and Promotions. To send you email and push notification marketing about our and our affiliates’ products and services; and to send you news and newsletters. To assist us in sending you advertisements on our Site and App and to evaluate the success of our adverting campaigns.

Analytics. To better understand how users access and use our Services, both on an aggregated and individualized basis. For example, we will log and evaluate which features of our Site and App are more (or less) used by users, which features are causing bugs or performance issues, which activities lead to other activities, and which activities are correlated with increased use of the App.

Information Gathering. To administer surveys and questionnaires, such as for market research or member satisfaction purposes.

Legal Compliance. To comply with legal obligations, as part of our general business operations, and for other business administration purposes.

Protecting Us and Others. Where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of our Terms of Service or this Privacy Policy. For example, we use technology provided by our service providers to review the content that you upload to confirm that it does not contain any explicit, illegal, or potentially offensive material. How We Share Your Information
We may share your information, including personal information, as follows:

Service Providers. We disclose the information we collect from you to service providers, contractors or agents who perform functions on our behalf. These service providers include entities that host our Site and App and provide other information technology services; entities that assist us in communicating with you; and entities that assist us in conducting our marketing and analytics activities.

Affiliates. We disclose the information we collect from you to our corporate affiliates.

Other Users. If you are a Creator or an Account User, you can share images with other individuals in a variety of ways, including the following:

Groups. Groups are the backbone of Backstory’s sharing system. You can set a group to automatically share with designated individuals. When you apply a group(s) to a saved image the image, location, date, caption, tag(s), face tag(s) and group name(s) are shared with all designated individuals from its group(s).

Tags. Tags are part of Backstory’s organizing system. Tags help to categorize images. When you apply a tag(s) to a saved image, the tag(s) name are visible to Joint Account Users and to anyone else that you or your Joint Account Users shared the image.

Face Tags. Face tags are part of Backstory’s sharing system. You can set a face tag to automatically share with designated individuals. When you apply a face tag(s) to a saved image, the image, its tag(s), its caption, its comment(s) and the first and last name of the face tag(s) are shared with all designated individuals from its face tag(s).

Traditional Sharing. You can share your images via text messaging, email, social media, or other external means. When you do so, we share that image with your chosen service provider. For example, when you text an image from your Backstory account, we need to send the image, caption, date and location to your text messaging service.

Partners. You can share your account with Joint Account User. Joint Account Users see your name, profile picture, email and mobile number. Joint Account Users will have access to all images that you save and enable for Joint Account Users sharing (“Joint Account User-shared images”), including their groups, tags, face tags, captions, dates and locations. Joint Account Users can edit groups, face tags, captions, dates and locations of Joint Account User-shared images. Joint Account Users can share partner-shared images to other individuals within and outside of Backstory.

Groups Shared with Your Joint Account User. When you share a group with your Joint Account User, they have the option to apply that group to their images and to your Joint Account User-shared images. They also have the option to share that group with additional individuals, beyond the designated individuals you chose when creating the group.

Face Tags Shared with Your Joint Account User. When you share a face tag with your Joint Account User, they have the option to apply that face tag to their images and to your Joint Account User-shared images. They also have the option to share that face tag with additional individuals, beyond the designated individuals you chose when creating the face tag.

Joint Account Users. When you share images with Joint Account Users, we notify them, and provide them with sample images (e.g., in an email or text notification) of the content you shared. Joint Account Users see your name, profile picture, email and the images you share. Joint Account Users can comment on images you share with them and can save your shared images to their Backstory account and share them with other individuals. If you delete an original image, we also delete it from all other Backstory accounts; however, note that we cannot identify and delete copies made of an image, stored in another location, or images shared outside of Backstory.

Thanks. If you thank a user for sharing an image with you, your thank-you note, first name, last name and profile are visible to the individual who shared the image with you and that individual’s Joint Account User.

Comments. If you comment on an image a user has shared with you, your first name, last name, profile picture, comment and date you submitted the comment are visible to the individual who shared the image with you, that individuals joint account users, and anyone else who had that image shared with them.
We also disclose information in the following circumstances:

Business Transfers. If (i) we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. As part of the business transfer process, we may share certain of your personal information, including with lenders, auditors, and third party advisors, (for example, attorneys and consultants).

In Response to Legal Process. We disclose your information to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.

To Protect Us and Others. We disclose your information when we believe it is appropriate to do so to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which we are involved.

Aggregate and De-Identified Information. We share aggregate, anonymized, or de-identified information about users with third parties for marketing, advertising, research or similar purposes.
We do not share your personal information with third parties for their own direct marketing purposes.
Our Use of Cookies and Other Tracking Mechanisms
We and our service providers use cookies and other tracking mechanisms to track information about your use of our Site, App and Services. We may combine this information with other personal information we collect from you (and our service providers may do so on our behalf).
Cookies. Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Site and Service. There are two types of cookies: session and persistent cookies.
• Session Cookies. Session cookies exist only during an online session. They disappear from your device when you close your browser or turn off your device. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site and Services. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site and Services.
• Persistent Cookies. Persistent cookies remain on your device after you have closed your browser or turned off your device. We use persistent cookies to track aggregate and statistical information about user activity.
Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site and Services who disable cookies will be able to browse certain areas of the Site, but some features may not function.
Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web and app pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site and Services to, among other things, track the activities of Site visitors and App users, and help us manage content, and compile statistics about Site usage. We and our service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
Analytics. We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site, and to the extent permitted, our Apps. We also may use other analytic means to evaluate our Site and Apps. We use these tools to help us improve our Site’s and Apps’ performance and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services. Cross-Device Use. We and our service providers, including Google, may use the information that we collect about you (whether directly from our Site, App, through your device(s), or from a third party) to help us and our service providers identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.). We, and our service providers also may use the cross-device use and other information we learn about you to serve targeted advertising on your devices and to send you notifications. To opt-out of cross-device advertising, you may follow the instructions set forth in the Ad Networks section below. Please note: if you opt-out of these targeted advertising cookies, your opt-out will be specific to the web browser, app, or device from which you accessed the opt-out. If you use multiple devices or web browsers, you will need to opt-out each browser or device that you use.
Do-Not-Track. Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt-out of targeted advertising by following the instructions in the “Ad Networks” section below.
Ad Networks
We use other entities such as network advertisers, advertisers, sponsors and/or traffic measurement services (“Advertisers”) to serve advertisements on our Site and App This enables us and these entities to target advertisements to you for products and services in which you might be interested. Advertisers may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These cookies and other technologies are governed by each Advertiser’s specific privacy policy, not this one. We may provide these Advertisers with information, including personal information, about you.
We may disclose certain information to other parties – such as Facebook (more info on Facebook Custom Audience here) – so that we can better target ads and content to our users, and others with similar interests on these external platforms or networks (“Custom Audiences”). We may also work with Advertisers that enable us and other participants to target ads to Custom Audiences submitted by us and others.
Users in the United States may opt out of many ad networks. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page for information about opting out of interest-based advertising and your choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page for information about opting out of interest-based advertising and your choices regarding having information used by NAI members.
Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Site or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective. We offer users the option to opt out of receiving targeting advertisements from us. If you use the paid version of our Services, you will also have the option to opt-out of all other in-App and in-Site advertising from us by selecting that option within the App’s account settings.
User Generated Content
We may invite you to post content on our Site and Services, including your comments, pictures, captions, and any other information that you would like to be available on our Site or Services. If you post content to our customer service forum, you will need to have an account and the content that you post will be visible to all visitors to our Site. If you post content to any blog or similar forum that we make available, your username and any content that you post will be available to all visitors to our Site. If you post your own content in the blogs and other forums on our Site or Services, your posting may become public and we cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy.
Links
Our Site and Services may contain links to other entities’ websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those websites. We are not responsible for the information practices of such websites.
Security of Your Personal Information
We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee security.
You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
Access To Your Personal Information
You may modify personal information that you have submitted by logging into your account through the App or Site and updating your profile information. You may also view and delete saved images from your library. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.
What Choices Do You Have Regarding Use of Your Personal Information?
We may send periodic promotional emails to you. You may opt-out of promotional emails by following the opt-out instructions contained in the notification email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional email, we may still send you emails about your account or any services you have requested or received from us.
Children Under 17
Our Services are not designed for children under 17. If we discover that a child under 18 has provided us with personal information, we will delete such information from our systems.

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on our App. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site and App or notifying you at the email address that we have on file for you.
